Elderbrew Cafe Refund, Return, Cancellation, and Event Rental Policy

This policy applies to purchases, reservations, registrations, and services provided directly by Elderbrew Cafe LLC, including:
- Cafe food and beverages
- Retail merchandise and collectibles
- Collectibles Market vendor spaces
- Admission tickets and special-event registrations
- Private cafe and property rentals
- Birthday parties
- Weddings and wedding-related events
- Corporate, community, and private gatherings
- Equipment, furniture, decor, and add-on rentals
- Deposits, retainers, and other event-related payments
By making a purchase, reserving a space, registering for an event, or entering into a rental agreement with Elderbrew Cafe LLC, the customer agrees to this policy and any additional written terms associated with the purchase or reservation.
If a signed contract contains terms that differ from this general policy, the signed contract controls.
1. General Refund Rules
Refund requests must be submitted to Elderbrew Cafe LLC using the contact information above. Requests should include:
- The customer’s name
- The order, receipt, or reservation number
- The date of purchase
- A description of the item or service
- The reason for the request
- Photographs when damage or defects are involved
Approved refunds will generally be returned to the original payment method. Cash refunds may require proof of purchase.
Processing times vary by financial institution. Elderbrew Cafe LLC is not responsible for delays caused by banks, credit card companies, payment processors, or other financial institutions.
Shipping charges, delivery charges, service fees, processing fees, convenience fees, and other amounts already paid to third parties are nonrefundable unless required by law or unless the refund resulted from an error by Elderbrew Cafe LLC.
Refunds will reflect the amount actually paid after discounts, coupons, credits, rewards, or promotional offers. A customer cannot receive a refund greater than the amount paid.
2. Retail Merchandise and Collectibles
Eligible Returns
New, unopened, non-collectible retail merchandise purchased directly from Elderbrew Cafe LLC may be returned within 14 calendar days of purchase if:
- The customer presents the original receipt or other acceptable proof of purchase.
- The merchandise is unused and in its original condition.
- All packaging, labels, accessories, and components are included.
- The merchandise can reasonably be offered for sale again as new.
Elderbrew Cafe LLC may provide a refund, exchange, replacement, or store credit, depending on the circumstances and available inventory.
Final-Sale Collectibles and Products
Because condition, authenticity, scarcity, market value, and packaging are important to collectible products, the following are final sale unless the item was materially misrepresented, counterfeit, or damaged before the sale:
- Individual trading cards
- Graded cards and slabs
- Comics and graded comics
- Autographed merchandise
- Vintage items
- Action figures and collectible toys
- Video games and systems sold as used
- Blind boxes and mystery products
- Mystery packs and repackaged card products
- Opened trading card products
- Booster packs, booster boxes, tins, bundles, and other sealed trading card products
- Clearance, liquidation, and specifically marked final-sale items
- Consignment items
- Custom-made and personalized items
- Items whose protective seal, shrink wrap, packaging, or tamper-evident material has been opened, removed, altered, or damaged after purchase
Fluctuation in market value, discovery of a lower price elsewhere, dissatisfaction with random contents, unsuccessful pulls, grading outcomes, buyer’s remorse, or a change in collecting preference does not qualify an item for a refund.
No particular card, rarity, pull, value, character, grade, or financial return is guaranteed unless expressly stated in writing.
Condition and Inspection
Customers are encouraged to inspect collectible products before completing an in-person purchase. The condition shown and accepted at the time of purchase will be considered the condition in which the item was sold, except for defects that could not reasonably have been discovered during inspection.
Minor manufacturer variations, print lines, centering issues, packaging wear, dents, scratches, factory defects, or other production imperfections are not automatically considered defects caused by Elderbrew Cafe LLC.
Authenticity or Material-Description Concerns
If a customer reasonably believes an item sold directly by Elderbrew Cafe LLC is counterfeit or materially different from its written description, the customer must contact Elderbrew Cafe LLC promptly and return the item in the same condition in which it was sold.
Elderbrew Cafe LLC may inspect the item, verify identifying information, and obtain an independent opinion before approving a refund. Intentional substitution, alteration, tampering, or return of a different item will result in denial of the request and may be reported to the appropriate authorities.
Nothing in this policy eliminates rights that cannot legally be waived.
3. Cafe Food and Beverages
Food and beverages are generally nonreturnable and nonrefundable once prepared, served, picked up, or delivered.
If an order is incorrect, missing an item, improperly prepared, or reasonably believed to be unsafe, the customer should notify a staff member immediately. When appropriate, Elderbrew Cafe LLC may:
- Remake the item
- Replace the item
- Offer a comparable substitute
- Issue store credit
- Refund the affected item
A full-order refund is not guaranteed when only one item is affected.
Personal taste preferences, failure to read an ingredient description, or a change of mind after preparation generally do not qualify for a refund.
Customers are responsible for informing staff about allergies and dietary restrictions before ordering. Although reasonable care may be taken, Elderbrew Cafe LLC cannot guarantee that any item is completely free of allergens or cross-contact unless expressly stated in writing.
Preordered food, beverage packages, custom menus, and catering items may be subject to separate cancellation deadlines because ingredients, labor, and supplies may be committed in advance.
4. Purchases From Independent Market Vendors
Vendors participating in the Elderbrew Cafe Collectibles Market are independent sellers. Merchandise purchased from an independent vendor is sold by that vendor, not by Elderbrew Cafe LLC, unless the receipt specifically identifies Elderbrew Cafe LLC as the seller.
Each independent vendor is responsible for:
- The condition and authenticity of the vendor’s merchandise
- Product descriptions and representations
- Pricing and sales tax obligations
- Refunds, returns, exchanges, and warranties
- Customer disputes arising from the vendor’s transactions
- Compliance with applicable laws
Customers must direct refund and return requests to the vendor who completed the sale. Elderbrew Cafe LLC does not guarantee vendor merchandise and is not responsible for issuing refunds on behalf of independent vendors.
Elderbrew Cafe LLC may assist with identifying or contacting a vendor when reasonably possible, but assistance does not make Elderbrew Cafe LLC responsible for the transaction.
5. Collectibles Market Vendor Fees
Vendor registrations, indoor table fees, porch table fees, outdoor booth-space fees, electrical-access fees, advertising upgrades, sponsorships, and other market-related charges reserve limited space and may cause Elderbrew Cafe LLC to turn away other vendors.
Unless Elderbrew Cafe LLC cancels the market, vendor fees are nonrefundable.
This includes cancellations caused by:
- A vendor’s change of plans
- Illness or scheduling conflicts
- Transportation or staffing problems
- Unsatisfactory sales or attendance
- Failure to obtain required licenses, permits, insurance, or approvals
- Failure to arrive or set up on time
- Removal for violating market rules
- Weather that does not result in an official cancellation by Elderbrew Cafe LLC
A vendor who cannot attend may request permission to transfer the reservation to another approved vendor or date. Transfers and credits are not guaranteed and must be approved in writing before the event.
Failure to attend does not cancel a recurring vendor plan or subscription. The vendor remains responsible for cancelling future recurring payments through the designated website or by obtaining written cancellation confirmation from Elderbrew Cafe LLC.
Market Cancellation by Elderbrew Cafe LLC
If Elderbrew Cafe LLC cancels the entire market before it begins, affected vendors may be offered, at Elderbrew Cafe LLC’s option:
- A transfer to another available market date
- An account credit
- A refund of the vendor-space fee paid for the cancelled date
Third-party processing fees and separately delivered advertising or promotional services remain nonrefundable to the extent permitted by law.
If a market begins but is later shortened, interrupted, or closed because of severe weather, an emergency, unsafe conditions, government action, or another circumstance outside Elderbrew Cafe LLC’s reasonable control, refunds are not guaranteed. Any credit or partial refund will be determined based on the circumstances and costs already incurred.
6. Admission Tickets, Classes, and Special Events
Unless a specific event listing states otherwise, tickets and registrations are nonrefundable but may be transferred to another person before the event with written approval.
Missing an event, arriving late, being denied entry for violating event rules, or leaving early does not qualify for a refund.
If Elderbrew Cafe LLC cancels an event and does not provide a replacement date, the amount paid directly to Elderbrew Cafe LLC for admission will be refunded. Travel, lodging, vendor purchases, and other incidental expenses will not be reimbursed.
If an event is rescheduled, the original ticket will normally remain valid for the new date. A refund may be requested within the deadline included in the rescheduling notice.
7. Private Events, Weddings, and Party Reservations
Private events include weddings, receptions, ceremonies, birthday parties, showers, rehearsal dinners, corporate gatherings, private markets, photography sessions, and other reserved uses of the cafe or property.
A date is not reserved until Elderbrew Cafe LLC has received:
- A signed rental agreement
- The required reservation retainer
- Any required security deposit
- Any required proof of insurance or permits
Verbal discussions, price quotes, tentative holds, social-media messages, and unsigned proposals do not constitute a confirmed reservation.
Reservation Retainer
Unless the signed agreement states otherwise, a nonrefundable reservation retainer equal to 50% of the estimated rental charges is required to reserve an event date.
The reservation retainer compensates Elderbrew Cafe LLC for reserving the date, performing planning and administrative work, and declining other potential bookings. It is applied toward the total contract price but is not a refundable security deposit.
Remaining Balance
Unless otherwise stated in the signed agreement:
- The remaining balance for weddings and events with 50 or more expected guests is due 30 days before the event.
- The remaining balance for birthday parties and smaller private events is due 14 days before the event.
- Additions, overtime, damage, cleaning, and other charges incurred after the final payment may be charged separately.
Failure to pay by the deadline may be treated as a cancellation by the renter. Elderbrew Cafe LLC may release the date and retain all amounts permitted under this policy and the signed agreement.
Customer Cancellation Schedule
Unless different terms appear in the signed agreement:
- More than 120 days before the event: Payments above the nonrefundable reservation retainer may be refunded.
- 61 to 120 days before the event: The reservation retainer remains nonrefundable. Additional amounts paid may be refunded, less nonrecoverable expenses and custom-order costs.
- 31 to 60 days before the event: The reservation retainer and 50% of all other rental charges are nonrefundable.
- 30 days or fewer before the event: All payments are nonrefundable.
- Failure to appear or abandonment of the event: All payments are forfeited.
Custom goods, personalized materials, permits, special-order rentals, entertainment, food, beverages, staffing, decorations, and other costs already committed or paid on the renter’s behalf are nonrefundable at any time.
Cancellation notices must be submitted in writing. The effective cancellation date is the date Elderbrew Cafe LLC receives the written notice.
8. Rescheduling Private Events
One rescheduling request may be considered if submitted in writing at least 60 days before the original event date.
Rescheduling is subject to:
- Availability
- Written approval
- Payment of any rescheduling fee
- Current pricing and package requirements
- Reimbursement of costs already incurred
- Execution of an updated agreement
The new event must generally occur within 12 months of the original date. A second rescheduling request may be treated as a cancellation.
If the replacement date costs more, the renter must pay the difference. A change to a less expensive date or package does not automatically create a refund or credit.
Reservations, payments, and retainers may not be sold or transferred to another person without written approval.
9. Weather and Outdoor Events
The possibility of heat, cold, rain, wind, humidity, insects, wet ground, or other normal outdoor conditions is an assumed risk of reserving an outdoor area.
Weather forecasts alone do not entitle the renter to cancel, reschedule, or receive a refund.
The renter is responsible for selecting any weather backup plan offered in the agreement. Indoor backup space is not guaranteed unless expressly reserved in writing.
If Elderbrew Cafe LLC determines that the property cannot safely or legally be used because of severe weather, a government order, a declared emergency, utility failure, structural damage, or another circumstance outside its reasonable control, the parties will follow the force-majeure section of this policy and the signed contract.
10. Force Majeure and Circumstances Beyond Reasonable Control
Elderbrew Cafe LLC will not be considered in breach for a delay, interruption, modification, or inability to perform caused by circumstances beyond its reasonable control, including:
- Hurricanes, tropical storms, floods, lightning, tornadoes, or severe weather
- Fire or property damage
- Power, water, sewer, septic, internet, or utility failure
- Epidemics, pandemics, or public-health restrictions
- Government orders or permit restrictions
- Civil disorder, terrorism, war, or threats to public safety
- Labor interruptions or supply-chain failures
- Road closures or transportation emergencies
- Serious illness, death, or an emergency affecting essential personnel
- Any condition making performance illegal, impossible, or unreasonably unsafe
When reasonably possible, Elderbrew Cafe LLC may offer a substitute date, replacement service, modification, or credit. Any refund will be limited to amounts paid directly to Elderbrew Cafe LLC, less services already performed, nonrecoverable expenses, custom purchases, and amounts paid or owed to third parties, to the extent permitted by law.
Elderbrew Cafe LLC is not responsible for consequential or incidental expenses such as travel, lodging, clothing, photography, entertainment, outside vendors, lost profits, or lost opportunities.
11. Cancellation by Elderbrew Cafe LLC
Elderbrew Cafe LLC may cancel or terminate a reservation if:
- Required payments are not made.
- Material information was misrepresented.
- Expected attendance exceeds the agreed capacity.
- Required insurance, permits, security, or approvals are not provided.
- The proposed activity is illegal, unsafe, or materially different from the activity disclosed.
- The renter, guests, or vendors violate property rules.
- Conduct threatens people, property, licenses, or business operations.
When cancellation results from the renter’s breach, all amounts paid may be retained to the extent permitted by law, and the renter remains responsible for damages and unpaid charges.
If Elderbrew Cafe LLC cancels for its own convenience and not because of the renter’s breach or a force-majeure event, payments for services not provided will be refunded. This refund will be the renter’s exclusive monetary remedy to the fullest extent permitted by law.
12. Security and Damage Deposits
A security or damage deposit may be required in addition to the reservation retainer.
The security deposit may be applied toward:
- Property or equipment damage
- Missing items
- Excessive cleaning
- Trash removal
- Stains, spills, glitter, confetti, wax, or prohibited decorations
- Overtime or late departure
- Unauthorized use of rooms or outdoor areas
- Repairing walls, floors, plumbing, landscaping, furniture, or fixtures
- Chargebacks, unpaid balances, or other contract violations
- Fines, penalties, or costs caused by the renter or the renter’s guests or vendors
The renter’s liability is not limited to the amount of the deposit. If damages exceed the deposit, the renter remains responsible for the balance.
Any refundable remainder will generally be returned within 30 days after the event and completion of the property inspection. Elderbrew Cafe LLC may provide an itemized explanation of deductions.
13. Guest Counts, Packages, and Reductions
Final guest counts are due by the deadline in the rental agreement. After that deadline:
- Guest counts may be increased only with approval and additional payment.
- Guest counts and package quantities cannot be reduced for a refund.
- Guests who do not attend do not qualify the renter for a refund.
- Charges may be increased if actual attendance exceeds the contracted count.
Minimum spending requirements, staffing minimums, rental minimums, and package minimums remain due even if fewer guests attend.
14. Food, Beverage, and Catering for Private Events
Food, beverages, ingredients, custom menus, cakes, and catering quantities ordered for a private event become nonrefundable once purchased, prepared, or committed.
Final food and beverage quantities cannot be reduced after the ordering deadline.
Outside food, alcohol, caterers, and vendors are permitted only when authorized in writing. Required permits, licenses, insurance, inspections, and food-safety compliance are the responsibility of the renter and applicable vendor unless the contract expressly states otherwise.
Unused food and beverages may not always be released to the renter when doing so would conflict with food-safety requirements.
15. Outside Vendors
Photographers, caterers, entertainers, decorators, rental companies, officiants, coordinators, and other outside vendors are independent businesses.
Elderbrew Cafe LLC is not responsible for an outside vendor’s:
- Performance or failure to appear
- Merchandise or services
- Refunds or cancellation terms
- Damage, negligence, delay, or misconduct
- Licensing, permits, insurance, or legal compliance
The renter remains responsible for the conduct of all vendors brought onto the property and for ensuring that they follow venue rules.
Cancellation of an outside vendor does not cancel the renter’s obligations to Elderbrew Cafe LLC.
16. Rental Equipment, Furniture, and Decorations
Rental items must be returned or left in the agreed location and condition.
The renter is responsible for replacement or repair costs associated with:
- Lost or stolen items
- Breakage
- Burns, stains, water damage, or misuse
- Damage caused by children, guests, contractors, or vendors
- Unauthorized movement or outdoor use
- Failure to return items by the agreed deadline
Normal wear will not be charged as damage.
Refunds are not available for rental items that were available and functional but not used by the renter.
If Elderbrew Cafe LLC cannot provide a reserved item, it may provide a reasonably comparable substitute or refund the charge for the unavailable item. The unavailability of a minor rental item does not automatically entitle the renter to cancel or receive a full-event refund.
17. Event Hours, Setup, Cleanup, and Overtime
Rental time includes setup, deliveries, decorating, the event itself, cleanup, and removal of personal property unless the agreement states otherwise.
Additional time is not guaranteed. When permitted, overtime will be charged at the rate stated in the agreement or the current overtime rate.
Early arrival, late departure, incomplete cleanup, or property left behind may result in additional charges.
Personal property left after an event may be moved or discarded after reasonable efforts to contact the owner. Elderbrew Cafe LLC is not responsible for loss, theft, or damage to unattended property except as required by law.
18. Gift Cards, Credits, Coupons, and Promotions
Gift cards and account credits are not redeemable for cash except where required by law.
Promotional certificates, complimentary tickets, discounts, and coupons have no cash value. If a purchase made with a gift card or credit qualifies for a refund, the refund will generally be returned as gift-card value or account credit.
Coupons and promotions cannot be applied retroactively unless expressly authorized.
Credits must be used by any disclosed expiration date, subject to applicable law. Credits are not transferable unless approved in writing.
19. Online Orders, Pickup, and Shipping
Customers are responsible for providing a correct shipping or pickup address and accurate contact information.
An order cannot be cancelled after it has shipped or after fulfillment has begun for a custom, perishable, or final-sale item.
Shipping damage or missing contents must be reported within three calendar days of delivery. The customer must preserve all packaging and provide photographs when requested.
Elderbrew Cafe LLC may require the customer to cooperate with a carrier investigation. Refunds or replacements may be delayed or denied if packaging is discarded, evidence is unavailable, or tracking confirms delivery and there is insufficient evidence of loss.
Risk associated with an incorrect address supplied by the customer, refusal of delivery, or failure to retrieve a held package remains with the customer. Additional shipping charges may be required for redelivery.
20. Chargebacks and Payment Disputes
Customers should contact Elderbrew Cafe LLC before filing a chargeback so the business has an opportunity to investigate and resolve the issue.
Filing a chargeback does not automatically cancel a contract, reservation, recurring plan, or outstanding balance.
Elderbrew Cafe LLC may provide the payment processor with contracts, receipts, communications, delivery records, photographs, access records, and other information relevant to the dispute.
Fraudulent chargebacks, false claims, and unauthorized payment disputes may result in cancellation of services, collection activity, denial of future transactions, and recovery of allowable costs.
21. Refund Abuse, Fraud, and Right to Refuse a Return
Elderbrew Cafe LLC may refuse a return, refund, exchange, or future transaction when there is reasonable evidence of:
- Fraud or attempted fraud
- Item substitution
- Altered receipts or payment records
- Excessive or abusive returns
- Intentional product damage
- Chargeback abuse
- Misrepresentation of item condition
- Violation of this policy
Identification may be requested to prevent fraud. Any information collected will be handled in accordance with applicable law.
22. Taxes and Fees
When a taxable sale is fully or partially refunded, any refundable sales tax will be handled as required by applicable law.
Fees paid to unrelated third parties are not refundable by Elderbrew Cafe LLC. Customers must pursue any refund available under the third party’s separate terms.
23. Limitation of Policy
Nothing in this policy waives or limits any right, warranty, remedy, or responsibility that cannot legally be waived.
If part of this policy is found invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
Failure by Elderbrew Cafe LLC to enforce a provision on one occasion does not waive its right to enforce that provision later.
24. Policy Changes
Elderbrew Cafe LLC may update this policy from time to time.
The policy in effect when a retail purchase is made will generally govern that purchase. Private rentals, weddings, birthday parties, and other contracted events will be governed by the signed agreement and the policy incorporated into that agreement.
Changes will not retroactively reduce a customer’s nonwaivable legal rights.

Submitting a request does not guarantee approval. Elderbrew Cafe LLC will evaluate each request under this policy, the applicable agreement, and governing law.
